1. Acceptance of Terms

By registering for, accessing, or using EduSaint+, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the app on behalf of an educational institution, you represent that you have the authority to bind that institution to these Terms.

2. Eligibility

To use EduSaint+, you must:

• Be at least 13 years of age (or have parental consent if under 13)
• Be a student, teacher, or educational institution administrator
• Provide accurate and complete registration information
• Not be prohibited from using our services under applicable laws

3. Account Creation and Security

When you download EduSaint+, an account is automatically created using your device ID. You may also add an email address and username. You are responsible for:

• Maintaining the confidentiality of your account information
• All activities that occur under your account
• Notifying us immediately of any unauthorized account access
• Keeping your email address updated for important communications

4. License and Premium Features

EduSaint+ offers both free and premium features:

• Free Features: Access to practice questions (limited to 3 per topic), basic progress tracking, and all subjects
• Premium Features: Unlimited questions per topic, detailed performance analytics, topic-based recommendations, priority support, and ad-free experience
• License Cost: Premium license fees are listed in the app and are subject to change
• License Term: Licenses are valid for one year from the date of purchase
• Device Binding: Licenses are tied to a specific device ID and cannot be shared across multiple devices

5. Payments and Refunds

All payments for premium licenses are processed securely through Flutterwave. By making a payment, you agree to the following:

• Payment Methods: We accept Nigerian bank cards (Verve, Mastercard, Visa), USSD banking, and direct bank transfers
• No Refunds: All license purchases are final. We do not offer refunds for any reason after payment
• Price Changes: We reserve the right to change license fees at any time. Price changes will not affect existing license holders until renewal
• Failed Payments: If a payment fails, your premium access will not be activated until the payment is successfully processed
• Billing Information: You are responsible for providing accurate billing information

6. User Conduct and Prohibited Activities

You agree NOT to engage in any of the following prohibited activities:

• Attempting to reverse engineer, decompile, or disassemble the app
• Using the app for any illegal purpose or in violation of any laws
• Sharing exam questions, answers, or materials without authorization
• Attempting to bypass license verification or payment systems
• Creating multiple accounts to exploit free features
• Uploading malicious code or attempting to compromise app security
• Harassing, abusing, or harming other users
• Impersonating any person or entity
• Using automated scripts to interact with the app
• Transferring or selling your license to another person or device

7. Content and Intellectual Property

All content available on EduSaint+, including but not limited to:

• Practice questions and answers
• Study materials and resources
• Software code, designs, and graphics
• Trademarks and logos
• User interface and layouts

is the exclusive property of Edusaint Nigeria Limited or its licensors and is protected by Nigerian and international copyright laws. You may not copy, distribute, modify, create derivative works of, or publicly display any content without our prior written consent.

8. Data Collection and Privacy

Your use of EduSaint+ is subject to our Privacy Policy. By using the app, you consent to the collection and use of your information as described in the Privacy Policy, including:

• Device ID for account creation and license binding
• Practice session data for performance tracking
• Email address (optional) for account recovery
• Payment information (processed securely by Flutterwave)

9. Offline-First Architecture

EduSaint+ is designed as an offline-first application. This means your practice data is stored locally on your device. We recommend periodically syncing your data when connected to the internet to ensure your progress is backed up. Edusaint is not responsible for data loss due to device damage, loss, or factory resets.

10. License Transfer and Device Changes

Licenses are tied to a specific device ID. If you:

• Lose your device: Contact support to have your license transferred to a new device
• Get a new device: Contact support with your email address for license transfer assistance
• Uninstall the app: Your license may be lost if you do not have an email associated with your account
• Factory reset your device: Your license will be lost unless you have an email on file

We strongly recommend adding an email address to your account in the Account page to enable license recovery.

11. Third-Party Services

EduSaint+ integrates with the following third-party services:

• Flutterwave: Processes payments for license purchases. By making a payment, you agree to Flutterwave's Terms of Service and Privacy Policy.
• Google Play Store: For app distribution and updates

12. Termination

We may suspend or terminate your access to EduSaint+ at any time, without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Cheating, fraud, or abuse of platform features
• Attempting to bypass license verification
• Request by law enforcement or government agency
• Technical issues or security concerns

Upon termination, you will lose access to all account features, including premium content and practice data. No refunds will be provided for terminated accounts.

13. Disclaimer of Warranties

EduSaint+ is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. We do not warrant that:

• The app will meet your specific requirements or academic goals
• The app will be uninterrupted, timely, secure, or error-free
• Exam results will lead to academic success or certification
• Any errors in the app will be corrected

14. Limitation of Liability

To the maximum extent permitted by law, Edusaint Nigeria Limited, its directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of EduSaint+, including but not limited to:

• Loss of data or practice progress
• Loss of license due to device changes or uninstallation
• Inability to access the app due to technical issues
• Academic performance or exam results

Our total liability shall not exceed the amount paid by you for a premium license in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Edusaint Nigeria Limited from any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of EduSaint+
• Violation of these Terms of Service
• Violation of any third-party rights, including intellectual property rights
• Violation of applicable laws or regulations

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Abuja, Nigeria.

17. Dispute Resolution

Before filing a legal claim, you agree to first contact us to resolve the dispute informally. If the dispute cannot be resolved informally within 30 days, either party may initiate formal proceedings. Any arbitration or legal action must be filed within one year after the claim arose.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Edusaint Nigeria Limited regarding your use of EduSaint+ and supersede all prior agreements.

20. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, strikes, internet failures, or government regulations.

21. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of changes through:

• In-app notifications
• Email (if you have provided an email address)
• Updating the "Last Updated" date at the top of this page

Your continued use of EduSaint+ after any changes indicates your acceptance of the modified Terms. If you do not agree with the changes, you must stop using the app and delete your account.
